These Terms govern your use of the HealthForMac macOS app, the HealthForMac iPhone companion app (together, “the App”), and HealthForMac.com (“the Site”), operated by Murilo Soares Pereira, based in Munich, Germany (“Developer,” “we,” “us”). By downloading, installing, or using the App, you agree to these Terms. If you do not agree, do not use the App.
This is an agreement between you and Murilo Soares Pereira only. Apple Inc. is not a party to these Terms and has no responsibility for the App.
1. License
Subject to these Terms, we grant you a personal, non-exclusive, non-transferable, revocable, limited license to install and use the App on Apple-branded devices you own or control, for your personal, non-commercial use, in accordance with the Usage Rules in Apple’s Media Services Terms and Conditions (including Family Sharing where applicable).
You may not: copy, modify, or create derivative works of the App; reverse-engineer or decompile it except as permitted by law; sell, sublicense, rent, lease, or redistribute it; or remove any proprietary notices. All rights not expressly granted are reserved.
2. Purchases and Payments
HealthForMac is currently sold as a one-time paid purchase through the Apple App Store, with no recurring charges. All purchases are processed by Apple. We do not collect or store any payment information. The current price is shown on the App Store. We may introduce optional paid services or features in the future; any such offering will be described at the point of sale.
Refunds are handled by Apple under its standard policies — request one at reportaproblem.apple.com. We cannot issue refunds directly, and we do not offer separate goodwill refunds; all refunds are handled by Apple through the App Store.
3. Maintenance and Support
We are solely responsible for support; Apple has no obligation to provide it. Reach support at hello@healthformac.com. We make reasonable efforts to respond but cannot guarantee response times — HealthForMac is made by a solo indie developer.
4. Not a Medical Device — No Medical Advice
HealthForMac is a personal data-visualization tool. It is not a medical device and is not intended to diagnose, treat, cure, or prevent any disease or condition.
- It reads and displays health data you already recorded in Apple Health; nothing it shows is medical advice or a diagnosis.
- It is not a substitute for professional medical advice, diagnosis, or treatment. Always consult a qualified healthcare professional about your health.
- If you are experiencing a medical emergency, call your local emergency services immediately.
- The App has not been evaluated or cleared by the FDA or any regulatory body. The accuracy of displayed data depends on your source devices and Apple Health.
Use of the App for clinical decision-making is prohibited and entirely at your own risk.
5. Intellectual Property
The App and Site — software, design, graphics, text, and logos — are owned by Murilo Soares Pereira and protected by applicable law. The HealthForMac name and logo may not be used without permission. HealthKit, iCloud, macOS, iPhone, and Apple Health are trademarks of Apple Inc., which does not endorse the App.
6. Disclaimer of Warranties
To the maximum extent permitted by law, the App and Site are provided “as is” and “as available,” without warranty of any kind, express or implied — including merchantability, fitness for a particular purpose, and non-infringement; that the App will be uninterrupted or error-free; or that the data it displays is accurate or suitable for any health-related purpose. If the App fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price; to the maximum extent permitted by law, Apple has no other warranty obligation.
7. Limitation of Liability
To the maximum extent permitted by law, in no event shall Murilo Soares Pereira be liable for any indirect, incidental, special, consequential, or punitive damages — including loss of profits, data, or goodwill — arising from your use of (or inability to use) the App, or any decision made in reliance on information it displays.
In no event shall our total liability exceed the amount you paid for the App, or USD $29, whichever is less. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
8. Apple Terms & Third-Party Beneficiary
Your use of the App is also subject to Apple’s Media Services and iCloud Terms and Conditions. You acknowledge that Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. We (not Apple) are responsible for the App, for addressing any product or intellectual-property claims relating to it, and for any maintenance and support.
9. Legal Compliance
By using the App you represent that you are not located in an embargoed country or on any U.S. Government list of prohibited or restricted parties.
10. Term and Termination
These Terms apply from your first use until terminated. Your license ends automatically if you breach these Terms or delete the App from all your devices. Sections 4–8, 11, and 12 survive termination.
11. Governing Law
These Terms are governed by the laws of the Federal Republic of Germany, without regard to conflict-of-law principles, and any dispute is subject to the exclusive jurisdiction of its courts. If you are an EU consumer, nothing here affects your mandatory local consumer-protection rights.
12. Changes & General
We may update these Terms; material changes update the “Last updated” date above and, where practicable, are noted on HealthForMac.com. Continued use after changes constitutes acceptance. If any provision is unenforceable, the rest remains in effect. These Terms and the Privacy Policy are the entire agreement between you and Murilo Soares Pereira regarding the App.
